This site is operated by Colombia Shoes Factory SAS, under the registered trademark BLACK BISON. We offer this website with all the information, tools, and services available to our users, stipulating the acceptance of all terms, conditions, policies, and notifications set forth here.

By entering the site and/or purchasing something from us, you agree to and are governed by the terms and conditions mentioned in the current document. These terms of service apply to all users of the site, including browsers, suppliers, customers, merchants, and/or content contributors. 

Only individuals of legal age according to their state or province of residence may make purchases through this website.

The acceptance of your order will be successfully completed when charges to your card have been made and the availability of the product has been verified.

We reserve the right to refuse any purchase for reasons we deem appropriate. In the event of rejecting an order that has already been paid, a refund will be processed via bank transfer or as agreed with the buyer.

It is important that you read the terms of service outlined here carefully before accessing or using our website. By using our website, you agree to be bound by these terms of service. If you do not agree with the terms and conditions of this document, you will not be able to access the website or use any of the services offered.

These terms of use are governed by applicable Colombian legislation.

Our website is hosted on Shopify Inc. They provide us with the online e-commerce platform allowing us to sell our products and services.

TERMS FROM THE STORE  

By accepting the terms of service, you declare that you are at least the age of majority in your state or province of residence, or are of legal age allowing a minor in your care to use this website with your consent. Black Bison assumes no responsibility for any false statement regarding your age and the fact that you made such a false statement constitutes a material breach of this agreement. 

The use of our products for illegal or unauthorized purposes is prohibited; it is also not permitted to violate the laws of your jurisdiction (including, but not limited to, copyright laws) in the use of the service.

You must not introduce viruses or destructive code.

Failure to comply with or violation of any of the terms of service will result in the immediate termination of your services.

GENERAL TERMS

We reserve the right to refuse service to anyone for any reason at any time.

You are aware that your content (excluding credit card information) may be transferred unencrypted and involve transmissions over various networks; and changes to conform and adapt to the technical requirements of connecting networks and devices.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of your use and access to the service, or any contact on the website through which the service is provided, without our express written permission.

The headings used in this agreement are included for convenience only and will not limit or affect these terms.

WEBSITE INFORMATION

This website may contain historical information; it is not necessarily up to date and is provided for your reference only. We reserve the right to modify the content of this website at any time, and we are not obligated to update any information on the site. You accept responsibility for reviewing any changes made to our site.

ACCOUNT INFORMATION

You have the option to create an account with Black Bison when making a purchase on the website. You agree that the information you provide during the account creation process is true. You also agree not to:  

• Selecting, registering, attempting to register, using the name or other identifiable information of another person who is not you with the intent to impersonate that person.
• Using the name of any other person without their express permission.
• Using a name that infringes on the intellectual property rights of any person. We reserve the right to refuse or cancel the account of any person who violates the terms of this agreement at our sole discretion. You will be responsible for maintaining the confidentiality of your password and will immediately notify Black Bison of any known or suspected unauthorized use of your account. You agree that you are responsible for all statements made and for any acts or omissions that occur in relation to your account while your password is being used.  

You must not authorize any third party to access or use the website to act on your behalf. If you do, you will be solely responsible for all acts and/or omissions of such third party in relation to the website. You are solely responsible for maintaining the confidentiality of your password and for all activities that occur as a result of its use. We cannot and will not be responsible for any loss or damage resulting from any unauthorized use of your account.  

You agree to provide Black Bison with true and accurate information in your order. Since the information you provide is essential for processing and delivering the order, for billing, and for establishing warranty contracts, failure to provide this information accurately and completely will result in the cancellation of your order. 

SERVICE AND PRICE VARIATIONS

The prices or descriptions of our products are subject to change without prior notice, at our sole discretion.

We reserve the right to modify or interrupt the service at any time (or any part or content of it) without prior notice. We are not responsible to the user or any third party for any modification, price change, suspension, or interruption of the service.

For orders to countries outside of Colombia, prices are indicated without taxes. These orders are subject to the taxes and customs duties of the destination country.

ABOUT THE PRODUCT OR SERVICE

Black Bison reserves the right not to confirm an order for any reason (including, but not limited to, item availability, issues with the received order, an abnormal order, foreseeable delivery issues, or problems with a previous order). 

Some products or services available exclusively online through the website may have limited quantities and are subject to return or exchange according to our return policy. 

When new product launches occur, these are usually limited; BLACK BISON reserves the right to sell a limited number of pairs per customer.

BLACK BISON reserves the right to cancel orders if a customer attempts to commit fraud and/or bypass the previous rule by making repeated purchases of the same product.

Similarly, we reserve the right to cancel a duplicate order, leaving exclusively the first one that has been correctly made at our discretion.

If any order is suspected of being made irregularly through bots or any other means that interferes with the launch regulations and/or violates the company's rules, generating priority for one customer over another, we reserve the right to cancel that order.

In special cases where simultaneous payments are generated on different platforms for a unique product or reference, priority will be given to the correctly completed purchase order, and the right to cancel subsequent purchase orders is reserved. It is important to know that payment for the product through the different offered means does not represent a completed purchase, but rather an order in process.

BLACK BISON reserves the right to cancel orders that it considers to violate the company's launch participation regulations; in such cases, it will contact the customer and inform them of the reason why the order has been canceled.

In these cases, the company will make a full refund, by bank transfer or as agreed with the customer, being free of any additional responsibility.

BLACK BISON is intended to reach end customers, for this reason we reserve the right not to sell to individuals classified as resellers, deducing that they have a past history or are considered as such in the market.

The display of colors and images of our products on the website has been done as accurately as possible. We cannot guarantee that your device's screen will reflect the product's color with total accuracy.

We reserve the right to:

• Limit the sales of our products or services to any user, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis.
• Limit the quantities of any product or service we offer.
• Discontinue any product at any time. Any product or service offer made on this website will be void where prohibited.

We cannot guarantee that the quality of the product, service, information, or other acquisition obtained or purchased by you will meet your expectations.

CONSIDERATIONS FOR COMBOS/PACKS IN THE PURCHASE

Combos or packs are considered an integral part of the product catalog and, therefore, the same general conditions of sale, warranty, and customer service apply.

It should be emphasized that, unless the pack has a specific promotion (discount or gift), no additional discounts can be applied to the pack (for example, they do not accumulate with general discount days or referral, birthday, first purchase promotions, etc.).

It should be noted that the availability of packs will depend on the current promotions on the site (for example, they do not apply when general discounts are activated in the store, such as on Black Friday).

BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order placed with us. We have sole discretion to limit or cancel quantities purchased by individuals, households, or orders. Restrictions may include orders placed by the same customer account, the same credit card, and/or with the same billing address or phone number provided at the time the order is placed.

We reserve the right to refuse or limit orders that, at our sole discretion, may be placed by dealers, resellers, or unauthorized distributors.

The user or customer agrees to provide current, complete, clear, and accurate purchase and account information for purchases made on the website. They agree to promptly update their account and relevant information, including email address, credit card numbers, and expiration dates, in order to complete transactions and communicate with us if necessary.

OPTIONAL TOOLS

We may provide access to third-party tools over which we do not monitor or have control or input.

You acknowledge and agree to access such tools 'as is' and 'as available' without warranties, representations, or conditions of any kind and without any endorsement. There is no liability related to or arising from the use of optional third-party tools.

The use of the optional tools offered is at your own risk and you must ensure that you are familiar with, agreeing to the terms provided by the relevant third-party providers' tools.

In the future, we may offer new services and/or features through the website (including the launch of new tools and resources). These will also be subject to the website's terms of service.

The obligations and responsibilities of the parties involved terminate when the agreement has been fulfilled as proposed.

These terms of service are effective except that you or we may cancel them. These terms of service may be canceled at any time by means of a notification stating the desire not to use our services or by leaving the website. If in our judgment, you do not comply, or there is suspicion that you have not complied with any term or its provisions, we may also cancel this agreement at any time without prior notice, and you will remain responsible for amounts owed up to the date of rescission and/or, consequently, access to our services may be denied.

AGREEMENT
